About the Program
 
Very special estate planning opportunities (and uncertainties) apply in 2012. Mr. Akers will discuss possible legislative outcomes and the timing of legislative possibilities, as well as the Administration's estate planning provisions in the 2012-2013 Budget Proposal. Special planning considerations for taking advantage of the $5 million gift exemption in 2012 will be covered. Mr. Akers will also discuss IRS regulations, which provide quite surprisingly favorable interpretations to facilitate planning opportunities with portability of the unused exclusion amount for gift and estate tax purposes.
Family limited partnership developments are continuing, with various cases over the last year addressing when section 2036 applies to assets contributed to FLPs, and when the gift tax annual exclusion is available for transfers of interests in FLPs or LLCs. Mr. Akers will discuss best practices in structuring and implementing defined value clauses are addressed in light of these developments.
 
About the Speaker
 
Steve R. Akers
Steve R. Akers, JD, is a Managing Director with Bessemer Trust Company, N.A., in Dallas, Texas, where he is Fiduciary Counsel for the Southwest Region and is in the Legacy Planning Department.
Mr. Akers is a member of the Advisory Committee to the University of Miami Philip E. Heckerling Institute on Estate Planning and is a frequent speaker at that Institute, as well as other estate planning seminars across the country. He is a past Chair of the American Bar Association's Section of Real Property, Trust & Estate Law. He is a Fellow of the American College of Trust and Estate Counsel, and currently serves a member of the Executive Committee, Regent, and Chair of the Business Planning Committee. He is a past editor of the ACTEC Law Journal.
Mr. Akers is a past Chair of the State Bar of Texas Real Estate, Probate and Trust Law Section and of the Dallas Bar Probate, Trusts and Estates Section. He is a co-author of A Planning Guide to Buy-Sell Agreements and Estate Planning After the Tax Relief and Job Creation Act of 2010.

Mr. Akers received his B.S. degree in Chemical Engineering from Oklahoma State University (1974) and his J.D. degree from the University of Texas School of Law (1977).
